Caselex’ commitment to data protection
Caselex BV (Caselex) runs an on-line legal information service (Service) operated at www.caselex.eu, selling subscriptions to its clients (Clients) allowing Clients’ staff (Users) to use this Service. Accordingly, Caselex is the controller responsible for the processing of data, including personal data, of the Clients and its Users of its Service. This notice explains Caselex’ online information practices, processing the (personal) data of these Clients and their Users using this Service.

Application of this notice
This notice (Notice) applies to contractual relationships (including pre- and post- contractual relationships) between Caselex and Clients and its Users and as such forms an integral part of the subscription agreement between Caselex and its Clients.

This Notice only applies to the data collected by Caselex from the Clients and its Users using the Service. It does not apply to information collected by Caselex in any other way.

Where the Service may contain links to information delivered through other on-line services operated by third parties, Caselex is not responsible for the data protection practices or policies of such third parties and this Notice does not apply to those services.

Registration of Clients and Users
Providing access to its Service to its (potential) Clients and Users, the Client agrees to provide information to Caselex, including the administrative details of the Client and the names and email addresses of the Users. In return Caselex provides (the option to create) a unique password to each of the Clients’ Users, allowing the Users to login to and use the Service. Users can change their passwords themselves any time.

The information collected during usage
Caselex offers a chat functionality allowing Users to seek help using the Service real time. Any information submitted by the Users through this chat functionality will be treated confidentially. Also, the Caselex Service offers Users the possibility to create and share folders and tags and to retrieve their searches done in the past. 

Caselex will not pass on or disclose the information described above to any third party. However, circumstances may arise where Caselex is required to disclose information collected to third parties in connection with a corporate divestiture or dissolution where Caselex would sell (a portion of) its business or assets (in which case Caselex will require this party to sign a non-disclosure agreement) or if disclosure is required by law or is pertinent to judicial or governmental investigations or proceedings.

Communications with Users
Caselex may email its Users occasional communications holding news items on new content (to be) published through its Services, such as recent notifications submitted to Competition Authorities and recent decisions from Competition Authorities and Courts. Users will be able unsubscribe from such communications by clicking the embedded link ‘unsubscribe’.

Data security
To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, Caselex has put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information collected.

Delivering its Service Caselex relies on a Virtual Private Server (VPS) operated by Mybit BV, a company established under the laws of the Netherlands and located at Koos Postemalaan 6, 1217 ZC Hilversum, the Netherlands, whose servers are physically based in the territory of the Netherlands. The service agreement between Caselex and Mybit BV is governed by Dutch law.

Delivering its Services Caselex relies on a 2048 bits SSL cryptographic protocol that uses a 256 bits algorithm to encrypt information exchanged between the server and any browser.

Access and correction of personal data
Clients and Users can request a copy of the personal data Caselex has collected within the framework of their contractual relationship and request Caselex to address any factual inaccuracies therein, by sending an email hereon to marc@caselex.eu
